01Who we are & scope
fjm.app is an independent systems and software consultancy operated by Fabio Maraschi. This policy applies to information we process through the fjm.app website and subdomains, our project and client work, and the emails we send and receive. It does not apply to third-party websites or services we link to, which have their own privacy policies.
02Information we collect
Information you provide to us
When you email us, respond to an outreach message, request a quote, or engage us for a project, you may provide: your name, email address, phone number, business or organization name, website, the contents of your messages, and details about your project, goals, and requirements.
Information collected automatically
When you visit the site, our hosting infrastructure automatically logs standard technical data such as your IP address, browser type, device and operating system, referring pages, and the pages you view, along with timestamps. This is used for security, diagnostics, and to keep the site running reliably.
Information from public and third-party sources
For business-to-business outreach, we may collect publicly available business contact information — such as a business name, website, phone number, general business email, and address — from public sources including business directories, mapping databases (for example, OpenStreetMap), and companies' own public websites. We use this to identify businesses that may benefit from our services and to contact them about relevant offerings.
03How we use information
- To respond to your inquiries and provide quotes and proposals.
- To deliver, maintain, and improve our consulting and development services.
- To send administrative and transactional messages related to a project or engagement.
- To send marketing or outreach messages where permitted, always with a way to opt out.
- To operate, secure, and improve the website.
- To comply with legal obligations and enforce our agreements.
We do not sell your personal information.
04Email & outreach practices
We use separate systems for different types of email, and we take deliverability and consent seriously:
- Cold business outreach is sent only to business contacts we have a legitimate business reason to contact, from a dedicated sending domain. Every such message identifies who we are, explains why we're contacting you, includes a valid postal address, and provides a clear, working way to opt out.
- Opted-in and transactional email (for example, replies, proposals, onboarding, and project updates) is sent only to people who have contacted us, replied, or otherwise agreed to hear from us.
- Opt-outs are permanent. If you unsubscribe or ask us to stop, we add your address to a suppression list and honor that request. We check that list before every send.
05Legal bases (GDPR)
If you are in the European Economic Area or the United Kingdom, we process personal data under one or more of the following legal bases: your consent; the performance of a contract with you; our legitimate interests in operating and promoting our business (balanced against your rights); and compliance with a legal obligation. Where we rely on consent, you may withdraw it at any time.
06How we share information
We share information only in these limited circumstances:
- Service providers / processors who help us operate, acting on our instructions — for example, our hosting and database provider (Railway), our transactional/opted-in email provider (Resend), and our cold-email sending platform (Smartlead). These providers process data only as needed to provide their services to us.
- Legal and safety reasons: to comply with applicable law, respond to lawful requests, or protect our rights, users, or the public.
- Business transfers: if the business is involved in a merger, acquisition, or asset sale, information may be transferred as part of that transaction.
We do not sell or rent personal information to third parties.
07Data retention
We keep personal information only as long as necessary for the purposes described in this policy — for example, to maintain a client relationship, meet legal, tax, and accounting requirements, and resolve disputes. Suppression-list entries are retained indefinitely so we can continue to honor opt-out requests. When information is no longer needed, we delete or anonymize it.
08Data security
We use reasonable technical and organizational measures to protect information, including encrypted transport (HTTPS), access controls, and reputable infrastructure providers. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
09International data transfers
We are based in the United States, and our service providers may process data in the United States and other countries. If you access the Services from outside these countries, your information may be transferred to, stored in, and processed in a country whose data-protection laws differ from those in your jurisdiction.
10Your rights & choices
Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information; to object to or restrict certain processing; and to withdraw consent. Under U.S. state laws such as the CCPA/CPRA, you may have the right to know what we collect and to opt out of “sales” or “sharing” of personal information — note that we do not sell personal information.
To exercise any of these rights, email admin@fjm.app. We will respond as required by applicable law. You will not be discriminated against for exercising your rights.
11Cookies & tracking
The public marketing site uses little to no cookies and does not run third-party advertising trackers. Our private admin area uses a single essential session cookie to keep an authenticated administrator signed in; it is not used for advertising. Your browser settings let you block or delete cookies, though some features may not work without them.
12Children's privacy
The Services are intended for businesses and adults. They are not directed to children, and we do not knowingly collect personal information from children under 16. If you believe a child has provided us information, contact us and we will delete it.
13Third-party links
The site may link to third-party websites and services (for example, GitHub or SoundBridge). We are not responsible for the privacy practices of those sites; review their policies separately.
14Changes to this policy
We may update this Privacy Policy from time to time. When we do, we'll revise the “Last updated” date above. Material changes will be indicated clearly. Your continued use of the Services after an update means you accept the revised policy.
