These Terms of Service (“Terms”) govern your access to and use of the fjm.app website and any content, services, or communications we provide (together, the “Services”), operated by Fabio Maraschi (“fjm.app,” “we,” “us,” or “our”). By using the Services, you agree to these Terms.

01Agreement to these terms

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services. If you are using the Services on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

02About the Services

fjm.app is an independent consultancy that designs and builds custom apps, automations, websites, and operational systems for creators and small businesses. The website provides information about these services, examples of work, and ways to get in touch. Website content is provided for general informational purposes and does not constitute professional, legal, or financial advice.

03Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services or engage us for work. The Services are directed to businesses and professionals, not to consumers seeking a regulated product.

04Consulting & development engagements

The website itself is not an offer or a binding contract for services. Any project or engagement is governed by a separate written agreement, proposal, or statement of work (“Engagement Agreement”) that we and the client sign or otherwise accept. That Engagement Agreement controls scope, deliverables, timelines, fees, ownership of deliverables, warranties, and termination. If anything in these Terms conflicts with a signed Engagement Agreement, the Engagement Agreement governs for that project.

05Quotes, pricing & promotions

Any prices, packages, promotional offers, or availability described on the website or in outreach messages are illustrative and subject to change without notice, and may be limited in number or time. They do not constitute a guaranteed offer. Final pricing and terms are confirmed in an Engagement Agreement. Third-party costs (such as domains, app-store fees, hosting, and licenses) may be additional and are the client's responsibility unless stated otherwise.

07Intellectual property

The website and its content — including text, design, graphics, logos, and the “fjm.app” name and marks — are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, revocable license to view the site for its intended purpose. You may not copy, reproduce, republish, or create derivative works from the content without our prior written permission. Ownership of deliverables created during a client engagement is addressed in the applicable Engagement Agreement.

08Email communications

When you contact us, you agree that we may respond by email. We send marketing or outreach email only where permitted by law, and every such message includes a way to opt out. You can unsubscribe at any time using the link in an email or by emailing admin@fjm.app. See our Privacy Policy for details on how we handle email and consent.

09Third-party services & links

The Services may rely on or link to third-party tools and websites (for example, hosting, email delivery, payment processors, and code repositories). We do not control and are not responsible for third-party services, their content, or their terms. Your use of them is governed by their own agreements.

10Disclaimers

The Services and website are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the website will be uninterrupted, error-free, or secure, or that any information is accurate or current. We do not guarantee any particular business result, revenue, or outcome from the Services or from any app, system, or campaign we may build.

11Limitation of liability

To the maximum extent permitted by law, fjm.app and Fabio Maraschi will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services.

For any direct damages, our total liability arising out of or relating to the website and these Terms is limited to one hundred U.S. dollars (US$100). Liability arising from a specific client engagement is governed instead by the applicable Engagement Agreement. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12Indemnification

You agree to indemnify and hold harmless fjm.app and Fabio Maraschi from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Services or your violation of these Terms or applicable law.

13Governing law & disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-laws principles. You agree that the state and federal courts located in Middlesex County, Massachusetts will have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to their jurisdiction and venue. We each agree to try in good faith to resolve any dispute informally by contacting the other first.

14General terms

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any Engagement Agreement, are the entire agreement between you and us regarding the Services.

15Changes to these terms

We may update these Terms from time to time. When we do, we'll revise the “Last updated” date above. Changes are effective when posted. Your continued use of the Services after an update means you accept the revised Terms.
